889 Compliance

The Section 889 policies issued under the Federal Acquisition Regulation (FAR) were enacted as part of the John S. McCain National Defense Authorization Act (NDAA) for financial year 2019 (Pub. L. 115-232).

889 Compliance Policies

The telecom rules listed in the Section 889 policies impact all U.S. Government contracts, prohibiting the government from buying or obtaining equipment, systems, or services that use covered telecommunications equipment or services produced by the following companies: Huawei, ZTE, Hikvision, Hytera Hangzhou, Dahua, their subsidiaries, and affiliates.

These rules also prohibit the Government from entering or renewing a contract with an entity that uses equipment, systems, or services that use covered telecommunications equipment or services as a substantial or essential component of any system or as critical technology as part of any system.

Section 889 also applies to Indefinite Delivery contracts, BPAs, and micro-purchases.
